When is a recall to prison lawful?

November 24, 2017/0 Comments/in News /by Kesar & Co

R (On the application of Goldsworthy) v The Secretary of State for Justice [2017] EWHC 2822 (Admin) All offenders and prison law practitioners are familiar with the process of recall back to prison. Once an offender has been released on licence, they must comply with conditions set by the Parole Board and monitored by their […]

Parole Board reliance on old reports?

November 14, 2017/0 Comments/in News /by Kesar & Co

Whilst it may be well known to some, the only way to challenge an Oral Parole hearing is via a Judicial Review, and this must be done promptly and within three months. The case of R (on the application of Ian Mordecai) v Parole Board [2016] EWHC 2601 (Admin)  resulted in a decision refusing a transfer […]

icons8There is less than a week left to send your applications so, if you are serious about having a career in #legalaid, don't miss this unique opportunity. Who else will pay you so little and demand from you so much? Where else can you find a job which may not have a pay rise... ever? And is there another job where your funds can be withheld and/or reduced while they pat you on the back for doing a good job? Come on, we know you want this... Send us your CVs. https://lnkd.in/dkBBbJ9m
icons8In August 2013, we set up a legal charity called Intervene Project as our response to the #LASPO cuts. Many of our current and past staff started as volunteers and have helped countless prisoners who, after LASPO, could not access #legalaid. Such work will remain important for so many people until such time, if ever, when the government decides to recognise our value and fund legal aid lawyers adequately. https://lnkd.in/da6sXXhV

icons8Radon and tobacco are the most common causes of lung cancer. When combined, the risk can be much, much higher. If you or your family members have been affected by the radioactive particles of radon in prisons, you may wish to contact our office to check if you have a claim. (Read More)

We are delighted to announce that four of our staff have passed their SQE exams and will soon be admitted to the Roll of Solicitors. Congratulations to Madeleine Wendling, Jonathan F., James Holloway and David Speed on this phenomenal achievement!!!

After the damage caused to the #legalaid system, it is inevitable that desperate people will seek help wherever they think they can get it. The need for free legal advice and representation will not disappear just because the publicly funded law firms have been decimated and rogue practitioners will be quick to sieze opportunity.

Was this intended by the Parliament when they voted for #LASPO ? If not, is it not right to repeal it? The damage that illegal, unregulated advice does to migrants, including asylum seekers, is extensive.

Hear from Alice, a law undergraduate who completed work experience at Intervene over the summer!
This is yet another compelling piece of evidence which shows that publicly funded firms survive only thanks to a decreasing number of committed firms and individuals who put their clients' interest before their own. But, will anyone notice this? Is this going to make any difference? ... Errr ... no.   Legal Aid Practitioners Group (LAPG)
... and this is just a beginning...
#LASPO destroyed publicly funded law firms and severely restricted access to justice. Intervene Project volunteers cannot change this but can mitigate the LASPO damage and help people in custody who cannot pay lawyers. Voluntary work with our charity also helps young law graduates to get hands-on skills and unmatched work experience. Can you spare one day each week over a period of three months? If so, please contact our charity and join their team. #accesstojustice #legalaid #prisoners

We at Kesar & Co fully support this campaign. As far as these "many civil legal aid lawyers in the field" are concerned ... well, there must be some, somewhere. Perhaps we are doing something wrong and they are avoiding us? Each time we recruit, we only get applications from young, aspiring lawyers without experience. We think that this is very positive so we train them and help them qualify as solicitors. After admission to the roll, most of them leave the sector and find jobs in the organisations which do not depend on legal aid.
We can complain as much as we like, but if it really mattered to anyone, it would be fixed after 30 years of waiting. It is even harder to explain to people who barely have enough money for food that they are too rich to be eligible for legal aid.

A little heart-warming message from our disabled client. It makes all the difference...

When a prison unlawfully opens a prisoner’s legal mail, it’s not just a technical breach—it’s a fundamental violation of their rights. Our client endured repeated breaches of legal mail confidentiality, causing significant distress, but when he raised complaints, he was met with intimidation from staff, accused of ‘finding a loophole in the system,’ and labelled a ‘serial litigator.’ He was also told that 'he would not get a penny from them'.

Our Sammy Bilton took action, challenging these breaches through legal proceedings. The result? A successful outcome, with our client receiving compensation and an acknowledgment of the wrongdoing. No one should face reprisals for asserting their legal rights.
