Lasting power of attorney and deputyship

We are committed to providing legal advice and support for these individuals and their families, so if the worst happens, their affairs continue to be managed in their own best interests.

We offer advice and services to create Wills and Trusts, Lasting Powers of Attorney and Deputyships for anyone who is vulnerable due to age, mental or physical disability.

Our consultant can help you work out what is the best way to provide financial and welfare support for your child or vulnerable adult after you are gone. She is an ex Special Needs Teacher with a wide range of experience catering for different levels of need, disabilities and circumstances and is committed to providing legal services for vulnerable people. She is available for home visits if necessary.

LASTING POWER OF ATTORNEY AND DEPUTYSHIP

For those who are underage, are vulnerable or have a disability or mental health issue, Lasting Power of Attorney or Deputyship can be given to a variety of people such as solicitor. You can choose who will best be able to look after their needs for the rest of their life when you cannot do so.

Making a Lasting Power of Attorney allows other people to take control of Property and Finance and/or Health and Welfare decisions if a vulnerable person finds it difficult, or will find it difficult in the future to make decisions for themselves. LPA’s can only be made when the vulnerable person has the mental capacity to give this power.

DEPUTYSHIP

Children and vulnerable adults who do not have mental capacity cannot make a Lasting Power oF Attorney

If the person you care for does not have mental capacity, you will need to make an application for Deputyship on their behalf. In addition, children and vulnerable adults will need to be provided for in a Will in order to make financial and care provision for their future.

If a Lasting Power of Attorney, Deputyship or Will (as appropriate) is not set up before they are needed, the government appoints Social Services to oversee the financial and welfare decisions needed by your vulnerable adult or child. By appointing others as Attorney or Deputy, it means they can work together with Social Services to make sure the right decisions are made.

We are able to assist in the preparation and application to the Court of Protection for Deputyship and can also provide our services to be appointed as Deputies ourselves should you not have anyone who is able to commit to the role.

The above prices do not include the fees payable to the Office of the Public Guardian for Lasting Powers of Attorney:
£110 per Power of Attorney or to the Court
of Protection for Deputyship Applications:
£400 per Application.
